In a court filing submitted on Wednesday, the company stated that Musk's acquisition offer contradicted its legal claims in a lawsuit filed against OpenAI last year. OpenAI argued in the filing that Musk's statements in the lawsuit, claiming that assets must remain with the non-profit organization and cannot be transferred to another entity for the public interest, are actually accusing Musk of hypocrisy. Previously in the lawsuit, Musk had stated that OpenAI must be managed by a non-profit organization, but now he is presenting the opposite view.
The board of directors of OpenAI has not formally rejected the offer.
