On September 30, Decrypt reported (citing Politico) that the Commodity Futures Trading Commission (CFTC) is investigating former Congressman Adam Kinzinger for betting on whether he would receive a presidential pardon through his Kalshi account. The trades took place between December 2024 and January 2025, where he placed bets on two contracts: 'whether he would be pardoned' and 'whether Biden would issue a preemptive pardon,' the latter of which came true. Kinzinger claimed to have only made $823, with about 25 trades resulting in losses, and denied any wrongdoing, stating that he has been out of office for two years, had no insider information, and had read the platform's rules in advance. Kalshi prohibits users from betting on contracts they are directly involved in, and the CFTC prohibits the use of significant non-public information; both the CFTC and Kalshi declined to comment.
