BAYC Creator Yuga Labs Emerges Victorious In Copyright Case

Yuga Labs, creator of the Bored Ape Yacht Club (BAYC) NFT collection, has won a pre-trial summary judgment in its trademark infringement case against Ryder Ripps and Jeremy Cahen. The RR/BAYC NFT collection contained identical copies of Bored Apes and used marketing material similar to that of BAYC. The court found that the duo utilized BAYC trademarks without Yuga Labs' consent, potentially causing confusion amongst buyers. The court ruled that Yuga Labs was entitled to an injunction and damages, which will be determined during a trial. Yuga Labs had initially asked for $200,000 in statutory damages, but this claim was dismissed. The BAYC creators described the judgment as a win for the entire Web3 industry.
